Personally appeared before me a Justice of the peace < Clerk of the Municipal Court> of said who being duly sworn deposeth and says that on the evening of the second day of February inst he was present at the time the circumstances referred to in the annexed Warrant transpired, and that he saw the said , & during nearly the whole of the evening aforesaid and that he is satisfied and verily believes that the aforesaid , & did not assault or beat the said Josiah Simpson on <in> any manner whatever, and this further says that he saw the said Josiah Simpson in an attitude to assault the aforesaid and that the said , & did nothing more than to defend themselves from the assaults of said Josiah Simpson and sought to enjoy the peaceable possession of their rights without useing any force, or voilence whatever and further this deponent saith not
