At the 25 March 1845 council meeting, Almon Babbitt raised the issue of Bent’s and Spencer’s impending grand jury service as a possible impediment to their participation on the Western Mission. They were not impaneled in Carthage until 19 May and then spent eight days at court. Spencer ultimately did depart to his assigned areas of the Western Mission with Charles Shumway in August 1845. (Council of Fifty, “Record,” 25 Mar. 1845; Spencer, Diary, 19 May and 3–5 Aug. 1845; see also Council of Fifty, “Record,” 9 Sept. 1845.)
