This Indenture, made and entered into this Seventeenth day of October in the year of our Lord, 1840 between Francis Church and Julia his wife of the county of Clark in the State of Missouri of the first part, and Joseph Smith of the County of & State of Illinois of Second part, Witnesseth, that we the said Francis Church & Julia his wife for and in consideration of the Sum of Two thousand dollars, to us in hand paid, by the said Joseph Smith the receipt whereof we do hereby acknowledged— have granted, bargained, and Sold, and do hereby grant, bargain, Sell, alien, confirm and convey, unto the Said, Joseph Smith & heirs and assigns the following described tracts of land viz: The East half of the South East quarter of section No thirty one in Township No five North of the base line of Range No Eight West of the fourth principal meridian containing Eighty acres more or less, The West half of the North West quarter of section No five in Township No four North of the base line of Range No Eight West of the fourth principal meridian containing Seventy four acres and 84/100 of an acre— more or less.— The East half of the North East quarter of Section No Six in Township No four North of the base line of Range No Eight west of the fourth principal meridian containing Eighty Two acres and 56/100 of an acre more or less— making in all Two hundred and thirty Seven acres and forty one hundreths of an acre more or less— All the aforesaid tracts of land, Situate lying and being in the County of and State of Illinois. Together with all the privileges and appurtenances to the Said lands in any wise appertaining and belonging. To Have and To Hold, the above granted premises, to Said Joseph Smith Jr his heirs and assigns, to his and their use and behoof forever. And the Said Francis Church and Julia his wife for themselves their heirs, executors, and administrators, do covenant with the Said Joseph Smith his heirs and assigns, that they are lawfully Seized, in fee of the aforegranted premises, that they are free from all incumbrances; that they have good right to sell and convey the Same to the Said Joseph Smith as aforesaid. And that we will warrant and defend the title to the same to the Said Joseph Smith his heirs and assigns forever, against the lawful demands of all persons. In testimony whereof, we have hereunto set our hand and Seal on the day and year aforesaid

This day personally came before me an acting justice of the peace within and for the aforesaid Francis Church whose signature appears to the above deed of Conveyance and who was proven to be the identical person who is described in and who executed the Same by Isaac R Cambell a credible witness who is personally known to me and he did acknowledge the Same to be his own free act and deed for the uses and purposes there in mentioned and expressed— Given under my hand and seal this 17th day of October A. D. 1840
