all and every such lots or parcels of land as have been bargained, sold and conveyed by deed, by the said to any person or persons since the above described tracts have been in his hands.—
To have and to hold the above described premises (excepting the reservations as aforesaid) with all their appurtenances, improvement and privileges unto the said Joseph Smith sole trustee in Trust for the Church of Jesus Christ of Latter day Saints. And the said and Rosannah [Robinson Marks] his Wife the aforesaid premises unto the said Joseph Smith Sole Trustee in Trust for the Church of Jesus Christ, excepting the reservations as aforesaid, against the claim or claims of all and every person whomsoever, do, and will Warrant and forever defend.— In Witness Whereof the said and Rosannah his wife parties of the first part, have hereunto set their hands and seals, the day, and year first above written.

I, a Justice of the Peace of said do certify that and Rosannah his wife whose signatures appear to the above and foregoing deed are personally known to me to be the identical persons described in and who executed the same and acknowledged the same to be their own free act and deed for the uses and purposes therein mentioned and expressed.— And the sd Rosannah Marks being made acquainted with the contents of said conveyance and examined by me separate and apart from her acknowledged that she relinquished her dower to the premises herein conveyed freely voluntarily and without compulsion of her . Given under my hand and seal this 11th. day of February A.D. 1841.
