money to Wm L. Turner, the sum of $400, The SE. qr of Sec. Seventeen in Township six North of range Eight west of the aforesaid meridian, on which there is yet due for purchase money the sum of $1400.00 to Abraham Tazier and that this piece of land is allotted to the widdow of said Erie Rhodes, decd.. The S.E. qr. of Sect. ten in Township Eight north of Range three West of the aforesaid meridian. The South East qr. of Sect two in Township Seven North of Range three of said meridian & the S.E. qr. of Sec. twenty eight in Township fifteen North of Range four east of said meridian and it also appearing to the satisfaction of the Court that there is debts, yet due against said Estate to the sum of five thousand two hundred and Sixteen dollars and Eighty cents for the payment of which there is no personal assets whatever. It is therefore ordered adjudged and decreed by the Court that said Hugh Rhodes, be authorized to sell and convey the above mentioned and described lands or so much thereof as may be necessary to pay and satisfy said sum of $5216.80 and the costs of the proceedings, and that said petioner be required to advertise said Lands for sale in the manner and for the time required by law, and that said sale be at public Vendue on the premises on a credit of six and nine months in equal payments and that petitioner take bond and security for the purchase money together with a mortgage on the premises sole to secure the payment of the purchase money, and that said petitioner report his proceedings herein to the next term of the Court untill which time this cause is continued. It is further ordered by the Court that said petitioner apply the proceeds of said lands in the first instance to the payment of the purchase money due on the same, respectively and in the next place to the payment of the general debts against said Estate.
