On the back of which said summons is the following endorsement made by the of to wit,

And afterwards to wit, on the 25th day of October in the year of our Lord one thousand Eight hundred and forty four the answer of Henry Stephens Esqr for the miner heirs was filed herein which said answer is in the words and figures following to wit,

And now comes Henry Stephens Guardian ad litem appointed by the court herein for , , & Frederick Smith infant defendants herein and for answer says that he is not informed of the matters & things in s Bill set forth & can neither admit nor deny the same & puts their rights in the protection of the court.
Henry Stephens being duly sworn says the matters set forth in the foregoing answer are true
