And now again Came the parties by their attornies and argued the s Motion Entered herein heretofore to dismiss this suit and also the s motion to dismiss the appeal taken herein and the Court being fully advised in the premises is of opinion that the said Motion to dismiss appeal be overruled and the said motion to dismiss suit be sustained and the suit dismissed for want of Jurisdiction of the Court below Whereupon it is considered by the court that the said have and recover of the Said his Costs by him in this behalf expended and may have execution &c [p. 473]
