And now at this day came the Circuit who Prosecutes for the in this behalf, (and there having been no Service of the Writ of upon the said Defendants herein) and Says that he will no farther Prosecute the said Indictment against the said defendants; It is therefore considered by the Court here that the said Defen[d]ants go hence thereof without day and that they recover of the said State of their costs by them in this behalf Expended.
