Harmon Wasson being duly sworn, on oath deposes and says, that he attended as witness in the cause wherein Joseph Smith is plaintiff, and & <are> defendant,s for two days at the Sept term A. D. 1843, of the Circuit Court of said , at the instance of said plaintiff
