To the Honorable Andrew Miller Probate Justice of the Peace in and for the County of in the State of Illinois
Your Petitioner of the County of in Said State of Illinois respectfully represents to your Honor that Joseph Smith of said , was appointed by the Probate Court of , guardian of , and others, heirs of deceased, and still continues guardian of said herirs, and that your petitioner and one , are security of the said Joseph Smith upon the bond given by him the said Smith as guardian of said children, and your represents that he has reason to believe and does believe that the said Joseph Smith who has possession of property to a large amount belonging to said heirs, is in danger of becoming utterly insolvent, if he is not already so, and that there will be great danger of the said heirs losing all of the property now in the hands of said Smith belonging to them unless the said Smith shall be compelled forthwith to appear before your honor and under his account upon oath touching the said guardianship, and your prays of this Hon Court that said Smith, guardian as aforesaid, be ordered by your Honor, to appear, before said Court in on Saturday <Monday> the <1st> day of June <July> 1844 then and there to submit to such examination by this Hon Court, as is by law in such case made and provided, and that your Honor will proceed in the premises, as shall appear to your Honor just and proper.
Your also represents to your Honor that the Co-surety with your upon said bond, has since the signing the same, been declared a bankrupt under [p. [1]]
