The following is a copy of the assignment refered to as aforesaid to wit.

I hereby assign into the hands of Joseph Smith all my right, title and claim to this Mortgage with Interest thereon July 20th 1843.
And whereas the said sum of money mentioned in said Mortgage having become due and payable together with the interest thereon, and the said having made default in the payment thereof and the same remaining due and unpaid. We therefore command you to make known to the said that he be and appear before the Circuit Court in and for the County of on the first day of the next term thereof to be holden at the Court House in on the Third Monday in the month of May AD 1845. to their cause if any he have why Judgment should not be rendered against him for such sum of money as may be due by virtue of said Deed of Mortgage. And have you then there this writ and make return thereof in what manner you execute the same.
