The East half of the South East quarter of section no thirty one (31) township five (5) north Range eight (8) West, also the West half of the north West quarter of section no. five (5) township four North (4) Range eight West (8). Also the East half of north East quarter of section no. six (6) township no four (4) N. R. 8 West of the 4 th pl. meridian in .
That afterwards and while said premises were subject to the lien of said Judgement the said Joseph Smith deceased and his wife conveyed the same by Deed to the said defendants (by the name of ) , and .
That as to the said the said deed was made in good faith upon a valuable consideration, but that as to the said , and the only consideration was love and affection, said , and then being infant children of said JosephSmith deceased.
And it further appearing to the Court that the said is entitled to be endowed of the one third of said premises during her natural life, and that for onesixth of the proceeds of the sale thereof she is willing to relinquish her dower in said premises.
And the appearance of the said Wood, Abbott and Co. now being entered by their Solicitor George Edmunds Jr.
And it further appearing to the Court that the said defendants , Lewis C. Bidamon, , Elisha Dixon, , , , , Thomas Wilson, George Greer, , Wood, Abbott and Co. Frederick R. Prentice, and the administrator of the said Joseph Smith deceased John M. Ferris being the only persons interested in any manner in said premises in this decree described.
And that the said bill and supplemental bill were at the last term of this Court taken as confessed as to the said Frederick R. Prentice.
And it further appearing to the Court that the said defendant is the owner in equity of three fourths of the said E 1/2 of the S. E. quarter sec. 31 T. 5 N. R. 8 W.
Also the W 1/2 of the N. W. qr. sec 5. T. 4 N. R. 8 W.
And also the E 1/2 of the N. E. qr. sec 6 T. 4 N. R. 8 W. herein before described.
And has since the death JosephSmith deceased made valuable improvements thereon.
And said is the equitable and legal owner of the other fourth of said premises.
