THIS INDENTURE, made and entered into this Twenty ninth day of May in the year of our Lord one thousand eight hundred and thirty- nine BETWEEN and Elizabeth [Wilcox Galland] his wife, of County, and State of of the first part, and late of the County of and State of of the second part, WITNESSETH, that the said parties of the first part, for an in consideration of the sum of One thousand & six hundred dollars, to them in hand paid, by the party of the second part, the receipt whereof is hereby acknowledged, have given, granted, bargained, and sold, and by these presents, do give, grant, bargain, sell, convey, and confirm, unto the said party of the second part, and to his heirs and assigns forever a certain piece or parcel of land, situate, lying, and being in the County of and Territoryand State ofof Iowa and described as follows, to wit: being Section Twenty four, in Township Sixty six North of Range Six West of the Fifth Principal Meridian, situate in Iowa Territory, in the Sac & Fox Half Breed Reservation, and containing six hundred and forty acres
TO HAVE AND TO HOLD, the aforesaid premises, together with all and singular the improvements, rights, privileges, and appurtenances thereunto belonging, or in any wise appertaining, unto the said party of the second part, and to his heirs and assigns forever, free from the claim or claims of themselves, their heirs, or assigns, and from the claims of any and every other person or persons claiming the same by, through, or under them or either of them. And the said parties of the first part, for themselves, their heirs, executors and administrators, covenant with the said party of the second part, his heirs and assigns, that they are lawfully seized of the above described premises, that they have good right, full power, and lawful authority, to sell and convey the same, and that the above described premises are clear and free of all encumbrances: And that they will WARRANT AND FOREVER DEFEND the title thereto, and hereby conveyed, against the lawful claim or claims of all and every person or persons claiming the same whomsoever.
IN TESTIMONY WHEREOF, the said parties of the first part, have hereunto subscribed their names, and affixed their seals, the day and year first above written.
