<May 17th 1839>
Now at this day the petitions of , and Maurice Phelps, Indicted for murder in the circuit court, being presented, praying for a change of venue, said petition being verified by the affidavit of said petititioners, and the hereof being satisfied that reasonable previous notice of said application has been given to the prosecuting It is therefore ordered that the venue in said cause be changed, for the reason as alleged by said applicants, that the minds of the inhabitants of the sixth, fifth and Eleventh circuits and every county in each of them, as so much prejudiced against them, that they cannot have a fair & impartial trial in any county in either of said circuits, It is further ordered that the trial of said cause be removed to the county of , by reason of the change of venue as aforesaid.
