and the said defendant comes by his attorneys and defends the force and wrongs <​and injurys​> set forth in the [’s] decleration and says the [that] he is not guilty of the said wrongs and greivance above laid to his charge or any or eithe[r] of these or any part of thereof in manner and form as the said hath above complaind against him in the first, second and third count of in said decleration set forth and of this the defendant puts himself

And the said Joseph Smith <​for​> further pleas comes and defends &c and says actio non because he says that after the committing of the said supposed wrongs and greivences by the said Joseph Smith in the first second and third counts of the said decleration of the said mentioned and every of them and before the commencement of this action to wit, on or about the first day of Febuery 1844 at the county of aforesaid he the defendant and the said meet togather to setle and compromis their differences and matters of and concerning the said supposed wrongs and greivences and the defendents says that [p.
