This day to wit the second day of December in the year of our Lord one thousand eight hundred and fifty came the defendant by his and filed his answer herein.
Which is as follows to wit:—
John Kelly, Answer, 22 November 1850
The seperate answer of the said defendant to the complainants bill filed herein.
And the said saving and reserving to himself all and all manner of exceptions to the many uncertainties, insufficiencies and informalities in the complainants’ bill for answer thereto or to so much thereof as he is advised it is necessary for him to answer says.
That he is the owner in fact of twenty six feet off the South side of lot four in Block one hundred and seventeen in the City of according to the plat of said bounded as follows:—
Beginning at the South East corner of said lot, thence North twenty six feet thence West forty feet, thence South twenty six feet, thence East forty feet to the place of beginning.
Respondant further says that he had a lien upon all of the balance of said lot four on Block 117, in aforesaid in said bill described, that during the year 1849 one Phineas Kimball was the owner of that part of said lot last aforesaid and conveyed the same to one Joseph S. Sanders by deed and said Sanders conveyed the same to by deed both of which said deeds are duly recorded in the Recorder’s office of Illinois, are now ready to be shown to the Court as they may direct,
That respondant at the April term of Circuit Court A. D. 1849 recovered judgement against the said Phineas Kimball and for the sum of $205.35 and costs of suit upon which judgement on the 11th. day of May A. D. 1850 an was issued upon said judgement to the sheriff of said which said execution was levied upon said lot 4 on Block 117 and said premises last aforesaid were by virtue thereof afterwards to wit, on the 6th day of June A. D. 1850 duly sold to your respondant for the sum of $241.42 by the Sheriff of said who made and delivered to your respondant a certificate of purchase therefor according to law the record of which said [p. 603]
