And afterwards to wit: On Wednesday the 24th day of April 1839. at the same court began and held as aforesaid the Grandjury aforesaid returned into Court the following which is in the words and figures following: to wit:

The Grand jurors for the State of for the body of the County of aforesaid upon their oath do present, That late of said County of , late of said County of and Maurice [Morris] Phelps late of said County of and divers other evil disposed persons (whose names to the Jurors aforesaid are as yet unknown) not having the fear of God before their eyes but being moved and seduced by the instigation of the Devil on the twenty-fifth day of October in [th]e year of our Lord eighteen hundred and thirty eight with force and arms at the County of aforesaid in and upon one Moses Rowland then and there being feloniously and wilfully and of their malice aforethought did make an assault, and that the said with a certain gun of the value of Ten Dollars then & there charged with gun powder and one leaden bullet which gun the said in both his hands then and there [p.
