he said nothing about setting up Smith at the well curb— or about some of the men being paralized, and had to be carried away from the Jail— I was about a 1/4 of mile from the Jail when the transaction took place— I Saw the smoke of the guns at the Jail— did not tell Worrill where his sword was— did not see him afterwards for several months— closed 1/2 past 11 o’clock
I have seen Williams [William] M Daniels— but not much acquainted with him— had a conversation with him about the killing of the Smiths at Mr. [Larkin] Scotts the night the Smiths were killed— I was in bed with Daniels at Scotts that night— cant say whether he slept or not— He told me that orders came from for the troops to disband and go home— that the two Smiths were killed— He told me that he had was not Satisfied that they Smiths were Killed and <that he> had come to from Prince’s Shanties to See— He did not State whether or not he was at the Jail when they were killed— I Supposed he had made an examination from what he Said, and had Satisfied himself that they were dead—
