did not hear raise any opposition to coming up here <to .>— Cant Say whether I Saw more than once that day— when I did See him he was on horseback— not prepared to Say what number volunteered—
Was in the day Jo. Smith was killed— was not in town all day— Came into town about 10. or 11 o’clock— knows all the defendants but Mr. [William] Grover— I Saw and in town that day, Shortly after I came in— perhaps it was about 11 oclock I Saw — did not hear him say any thing about the arrangements that were going on that day— Was up at the Jail when Smith was killed— was perhaps about 15 feet from the Jail— between 10 & 20 feet— at the S. E. Corner of the jail— was at the jail before the firing commenced— what took me there, was I Saw some men coming this way about a mile and a half off or more I was about a half a mile out east— and Saw their guns glistening— and I turned back— when I got back Saw some pretty near to the jail— I left my horse at and run up to the Jail— I heard some boys say the Mormons were coming to rescue the prisoners— and run up— [p. 46]
