not See any of these defendants there— as I run by I shook hands with him, and asked him the news— he said nothing special— Saw I then run on— Saw no one on the Courthouse— knew no one at the Jail but the Guards— thinks there were about 20 <or 25> who came to the jail— not as many as 50— See <saw> some a distance from the Jail— saw none with their faces blacked— they went off north west of the jail— did not notice which way they went— thinks they did not go down the lane between the two field beyond the on the other side of the Jail— when I first discovered the Carthage Greys they were marching— Capt. [Robert] Smith in front— I left the jail and came back before the Guards— Cross Examine.
Saw Smith when he fell out of the Window— Saw him when he first came to the window— <he> had blood on his pantaloons— I judge that he was shot before he fell— he was not dead when he fell— he raised himself up against the well curb— did not see any one take hold of him or raise him up— <I staid there until I saw him breathe his last—> did not see four men Shoot him after he was sitting up against the well curb— <Saw> no one paralized so that they could not move or get away— Saw no marvellous light about his body— when I first Saw him coming <before he fell> out of the window, his head, one [p. 48]
