There was a little memoradum of the evidence taken before the grand jury— by John J. Hancock [Hicok] who was clerk to the grand jury— it was read once or twice to the jury, and I think was Correct— I think that paper contains a correct Statement of the facts as they were detailed before the grand Jury— and would now be correct, if it has not been altered— James Reynolds, John J Hancock and myself took a little memorandum of the evidence— I dont know that I do recollect all that said on that occasion— Recollect that he said that they were at the Rail Road Shanties that day— I heard a part of his evidence yesterday— part of his testimony yesterday corresponded with his testimony before the grand jury— dont know that any of it differed as to what he said took place at the Shanties— he stated as he did yesterday that he came a-long, and was driving one of the Baggage Waggons— belonging to Mr. Fuller— Dont recollect that he said any thing about that day in coming up here— My impression is that he did not— but I am not willing to be certain about it, as my memory is indistinct— he said he saw a man by the name of Smith as they came up to the Chapman Place out on the prarie— I think he said before the grand jury, as he did here on yesterday that they seperated about four miles from here, and that the men went one way and the <​baggage​> waggons another— He said something about their being met by a Carthage Grey, and his evidence was the purport, that & were with the men when they were met by the Carthage Grey— and dont recollect— [p. 74]
