[illegible] as I passed the Square he was not with the grays I did not see any of the other Def[endan]ts at that time— I said nothing to I saw no man on the ground that I recognised except the guard untill it was all over— I should think there were 20 or 30 at the Jail— they went off West from the Jail I think I did take particular notice— I saw Smith come out of the window Smith— Smith was shot before he fell he raised himself against the well curb drew up one leg and streached out the other and died immediately I saw nothing of the light did not see the men paralised and carried away and if it had occurred I sertain I should have seen it

On the night Smith was killed I was at the house kept by Mr Flemming [Samuel Fleming] Mr F was not at home he was in Adeliene Garoot [Adeline Garoutte] & Ashbel Genung and Mrs [Ann] Fleming & several others were there— came there it was not yet quite dark and said that we have finished the [p. [26]]
