did not hear say any thing about killing the Smiths I saw here in the morning about 8 o clock on the morning on the day Smiths were killed

William Smith of
I was on the Grand Jury at the last term of this Court when the Inditements in this case were found on that ocasion a was was examined the same who testified here on yesterday— on that occasion he stated that was at the Jail at the time that the Smiths were killed and that he road a dark sorrell or bay horse— on that occasion he stated in substance that he was Driving one of the baggage waggons belonging to a Mr Fuller and came up within a 1/4 or 1/2 mile of the Jail and stopped and saw on horseback at the Jail— he was asked by some of the Jury whether he was acquainted with <​said he was​> and knew it to be him and he said that he could not be mistaken I think he stated that wroad out from the Jail [3 words illegible] & passed him— I [t]hink [3 words illegible] on his return to [3 words illegible] [ov]ertook them [p. [37]]
