and got into his waggon [William] Grover [John] Wills Vorus [William Voras] & Gallaher— I do not distinctly recollect that he said Chittenden told him to put out the baggage and turn back do not know that it was Chittenden evidence with the exception of his state about at the Jail was pretty much the same— he stated before the Grand Jury that the Carthage Gray was wanting wriding a Iron Gray poney— I dont distinctly recollect that [illegible] he state before Grand Jury what the Carthage Gray said when he came up [1/4 page blank]

I was on the G Jury at the last term of this Court— A Witness by the name of — said that he saw was at the Jail all the time the transaction sitting on a horse— states that a person met them who was said to be a Carthage Gray said and talked to & H Stevens [Henry Stephens] and said to [2 words illegible] that have was the time if [2 words illegible] was done— Mr McConnell [Murray McConnel] [2 words illegible] McConnell was here acting [2 words illegible] however as he told the Grand Jury [p. [39]]
