I am not I On the day Smith was killed I saw & I think [William] Grover I saw them at & at R S [railroad shanties]— heard say (I was in one of the a[d]vance companies after having been in the <at> rear came to the Adv) and saw had done all he could— he said somthing about coming to — cannot say what a call was made for v[olunteers] <col> do not know who made it— , < Ca to C[arthage?]> Said he be D if he was going to kill a man who was confined in Jail— I did <do> not k[now] whether Eighter [either] of the Def[endan]ts came to — E[li D.] Walker & Hampton Loftis & Richd Woodworth— I do <did> not hear the killing of the Smiths Publickly Talked of that day— started toward home— Did not see that day— Did not see baggage Waggon that day— I do not know that I did see fullers Wagg that day if his wagg was there that day I did not see it

I was in that day saw Smith killed did not see any of the Defts— there was 100 or 200 these were there from 3 to 4 minutes [p. [3]]
