[3 words illegible] this Wag[on] was attached to [2 words illegible] there were three. Cam[e] along G [William Grover] & the other from Green Plains we got to R R S— between 11 & 12 we halted there and Eat dinner— I know Col. saw him at R R— I know and saw him at R R— G & were there — read an order to disband the troops After dinner— I heard name of Def[endan]ts make a speach— was on horse back a Sorrel mare— was Do dont recollect what kind of hors on horsback— & G on foot G Called for volunters to go to to See <the > what he dismissed the men for with publick arms in their hands for— Did not hear any thing said about killing the Smiths— Did not hear or or call for vol I saw non of Defts but G untill we got half way here— then I saw & dont know whether I saw or not I saw About half mile from Jail then overtook them About 4 miles from here I saw G & — they then left did not See them any more untill we turned back— I was about 1/4 mile from Jail when Smiths were killed after I had stopped came up I dont recollect who they were they said nothing to me— Grover said Smith was a dam stout man he caugh[t] him [p.
